Telco Talk - Terms of use

This Acceptable Use Policy (here by referred to as "AUP") is intended to create boundaries of acceptable conduct that you the user must abide by. It can not be entirely inclusive of all user activities and therefore we reserve the right to change this policy without notice.

A "user" is defined as either a customer of telco-talk.com or a visitor to any site or service created, maintained, or hosted by telco-talk.com. As a user, you are bound by this agreement.

There are abuses and unacceptable boundaries that must be enforced through policy and by legal force where appropriate. We reserve the right to deny anyone, by any means, access to our systems and service who engages in unacceptable behavior as defined by this document. We also reserve the right to deny anyone, by any means, access to our systems and service who engages in unacceptable behavior not defined by this document. All judgments regarding the latter, is our right exclusively.

It is your responsibility to keep abreast of changes to the AUP.

Any "user" must never engage the following:

Illegal Use: Using the Services to transmit any material (by email, uploading, posting, or otherwise) that, intentionally or unintentionally, violates any applicable local, state, national or international law, or any rules or regulations promulgated thereunder.

Harm to Minors: Using the Services to harm, or attempt to harm, minors in any way.

Threats: Using the Services to transmit any material (by email, uploading, posting, or otherwise) that threatens or encourages bodily harm or destruction of property.

Harassment: Using the Services to transmit any material (by email, uploading, posting, or otherwise) that harasses another.

Slander: Using the Services to transmit any material (by email, uploading, posting, or otherwise) that slanders another.

Fraudulent Activity: Using the Services to make fraudulent offers to sell or buy products, items, or services or to advance any type of financial scam such as "pyramid schemes," "Ponzi schemes," and "chain letters." This may include with discression reserved by Telco-talk.com, any Multi Level Marketing (MLM) scheme, technique, or practice legal or illegal. We are MLM friendly, we do reserve the right to restrict or deny access to any MLM effort we feel is inappropriate regardless legality in the practice.

Forgery or Impersonation: Adding, removing or modifying identifying network header information in an effort to deceive or mislead is prohibited. Attempting to impersonate any person by using forged headers or other identifying information is prohibited. The use of anonymous remailers or nicknames does not constitute impersonation. Using deliberately misleading headers ("munging" headers) in news postings in order to avoid spam email address collectors is allowed.

Unsolicited Commercial E-mail/Unsolicited Bulk E-mail: Using the Services to transmit any unsolicited commercial email or unsolicited bulk email. Activities that have the effect of facilitating unsolicited commercial email or unsolicited bulk email whether or not that email is commercial in nature, are prohibited.

Unauthorized Access: Using the Services to access, or to attempt to access, the accounts of others, or to penetrate, or attempt to penetrate, security measures of Telco-talk.com or another entity's computer software or hardware, electronic communications system, or telecommunications system, whether or not the intrusion results in the corruption or loss of data. We do aggressively monitor and track security violations and unauthorized intrusions. While others may see the Internet as public domain, it is not and therefore access to our systems, networks, and services is by grace only. Any access deemed unacceptable is therefore subject to immediate termination of services and/or prosecution and/or reporting to any managing or governing authority we deem fit to enforce this policy.

Copyright or Trademark Infringement: Using the Services to transmit any material (by email, uploading, posting, or otherwise) that infringes any copyright, trademark, patent, trade secret, or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.

Collection of Personal Data: Using the Services to collect, or attempt to collect, personal information about third parties without their knowledge or consent. This does not apply to individual site subscriber or customer data. Collection of such data must abide by all laws local and abroad.

Reselling the Services: Reselling the Services without Telco-talk.com's authorization. We do not enter into reseller or partnership agreements without contract. The only currently authorized representative of Telco-talk.com is owned and operated by Telco-talk.com.

Network Disruptions and Unfriendly Activity: Using the Services for any activity which adversely affects the ability of other people or systems to use Telco-talk.com Services or the Internet. This includes "denial of service" (DoS) attacks against another network host or individual user. Interference with or disruption of other network users, network services or network equipment is prohibited. It is the Member's responsibility to ensure that their network is configured in a secure manner. A Member may not, through action or inaction, allow others to use their network for illegal or inappropriate actions. A Member may not permit their network, through action or inaction, to be configured in such a way that gives a third party the capability to use their network in an illegal or inappropriate manner.

Discussion Boards: Telco-talk.com and its Members should use their best judgment when posting to any discussion board. Many groups have charters, published guidelines, FAQs, or "community standards" describing what is and is not considered appropriate. Discussion Boards can be a valuable resource if used properly. The continued posting of off-topic articles is prohibited. Commercial advertisements are off-topic in most discussion boards, especially regional groups not specifically named for such. The presence of such articles in a group is not indicative of the group's "intended" use. Please familiarize yourself with basic Internet netiquette before posting to a discussion board.

Multi-Posting or Bulk-Posting: Telco-talk.com considers "multi posting" or "bulk posting" as having the potential to be excessive. Telco-talk.com does not normally restrict "multi posting" or "bulk posting", however, reserves the right to deny access to those who abuse our services. Telco-talk.com recognizes that content is a premium and therefore will allow users who "add value" as defined by Telco-talk.com to continue to "mulit post" or "bulk post" to any discussion group, link service, download service, news posting service, or any other similar service where it does not offend the policies defined within the AUP, the customer base, or user base of any site, or service that we provide.

High Bandwidth Services: Telco-talk.com reserves the right to limit or refuse service to anyone who engages in high bandwidth practices. Our customers are otherwise unrestricted. High bandwidth practices may have desruptive results to other customers. Any site or service provided that requires high bandwidth must not exist within the general public and requires special consideration. Telco-talk.com reserves the right to require any site owner or user who engages in such practices to either cease immediately, or enter into an agreement that appropriately defines boundaries, or Telco-talk.com reserves the right to deny service by any means to the offender.

E-Mail Lists: All user e-mail lists must operates as "Opt-In" email lists. All "Opt-Out" lists are prohibited. All attempts must be made to provide adequate and functional opting-out of all lists and services regardless of the nature.

Liability: No user or site owner may engage in any activity or speech that opens Telco-talk.com to liability. As well, we are not responsible for the activities of other users and therefore are not held liable for losses as a result of violations or other activities not defined by this document.

Network Services: No user may introduce any service into the network that acts as a server, or such similar application. These activities have the potential to violate network or system integrity. Telco-talk.com reserves the right to immediately terminate without notice any user access or site that provides services that Telco-talk.com does not agree with.

Other Network Activities: No user shall engage in the following; falsifying header information or user identification information, introduction of malicious programs into the network or Server (e.g. viruses, worms, Trojan horses, etc.), monitoring or scanning the networks of others without permission, attempted or successful security breaches or disruption of Internet communication including, but not limited to, accessing data of which customer is not an intended recipient or logging into a Server or account that customer is not expressly authorized to access, executing any form of network monitoring (e.g. packet sniffer) which will intercept data not intended for the customer, attempting to circumvent customer authentication or security of any host, network, or account ("cracking"), Using any program/script/command, or sending messages of any kind, designed to interfere with a third party customer terminal session, via any means, locally or via the Internet, sending unsolicited bulk email, maintaining an open mail relay, collecting email addresses from the Internet for the purpose of sending unsolicited bulk email or to provide collected addresses to others for that purpose, collecting email addresses from the Internet for the purpose of sending unsolicited bulk email or to provide collected addresses to others for that purpose, transmitting or receiving obscene, offensive, inflammatory, or slanderous material, furnishing false or incorrect data on the signup form, attempting to circumvent or alter the process or procedures to measure time, bandwidth utilization, or other methods to document "use" of Telco-talk.com's products and services.

Some activities listed within this document constitutes a "tresspass" and therefore is enforceable under RICO statues.

No user may engage in any activity to circumvent the authority of this document or Telco-talk.com's right to protect itself, systems, and services.

This document applies to all users and site operators and their users. It is the responsibility of the user to ensure that any user of their leased services be aware of these rules and restriction and abide by them.
